Introduction
This Privacy Policy describes how The Promptists LLC ("The Company," "we," "us," or "our") collects, uses, shares, and safeguards personal information when you use our website, applications, and related services (the "Platform").
By creating an account or using the Platform, you acknowledge and agree to the practices described in this Privacy Policy. If you do not agree, you must not use the Platform.
This Privacy Policy should be read together with our Terms of Service, which govern your use of the Platform. All capitalized terms not defined here have the meanings given in the Terms of Service.
1. Information We Collect
- 1.1 Information you provide directly. This includes account information (such as name, email address, password, phone number), profile details, project briefs, identity verification data (such as government ID, nationality, date of birth, proof of address), payment or payout details, support requests, marketing preferences, communications, voice recordings, video recordings, and transcripts made through the Platform.
- 1.2 Information collected automatically. This includes device information, IP address, browser type, operating system, approximate location, usage logs, clickstream data, search queries, and cookie or tracking identifiers.
- 1.3 Information from third parties. This includes information from payment processors, identity verification providers, analytics tools, or social or professional networks.
- 1.4 Inferred or derived information. This includes analytics, behavioral insights, performance metrics, and aggregated usage statistics.
2. How We Use Personal Information
- 2.1 Core Platform functionality. To create and manage accounts, verify identities, facilitate messaging, voice, and video communication, process payments, deliver projects, provide support, and operate the Platform.
- 2.2 Monitoring, safety, and enforcement. We actively monitor, record, transcribe, scan, analyze, and review communications on the Platform (including text, voice, and video) to enforce the Terms of Service, uphold non-circumvention rules, prevent harassment or abuse, detect fraud, block prohibited content or contact details, investigate reports, and maintain Platform integrity. Monitoring may include automated filtering and human review. Certain messages may be blocked or delayed automatically.
- 2.3 Platform security and improvement. To operate, maintain, test, and improve the Platform, including logging, diagnostics, debugging, analytics, service optimization, fraud prevention, and quality assurance.
- 2.4 Communications. To send transactional messages, service notices, alerts, updates, and-where permitted-marketing communications.
- 2.5 Legal and compliance purposes. To comply with applicable laws, KYC/AML requirements, regulatory obligations, tax rules, lawful requests, and to protect our legal rights.
- 2.6 With consent. Where we rely on consent (such as marketing), you may withdraw consent at any time.
- The lawful bases for processing include contract performance, legitimate interests (Platform safety, trust, and enforcement), compliance with legal obligations, and consent where applicable. By using in-Platform communications, you consent to the recording, storage, and analysis of such communications for the purposes stated in this Policy and the Terms of Service.
3. How We Share Personal Information
- 3.1 Service providers. With third-party vendors such as GetStream.io (messaging, recording, transcription), Stripe (payments), cloud providers, analytics platforms, and security or identity verification services. Payment card data is processed directly by Stripe; we do not store full payment card numbers.
- 3.2 Platform transactions. With Clients or Promptists as necessary to facilitate projects, communications, and Service Contracts.
- 3.3 Legal, safety, and enforcement. To comply with lawful requests, enforce the Terms of Service (including non-circumvention rules), resolve disputes, prevent fraud, block prohibited conduct, protect Users, and safeguard the Platform.
- 3.4 Corporate activity. In connection with audits, financing, mergers, acquisitions, or other business transactions, subject to confidentiality obligations.
- 3.5 With consent. Where you explicitly authorize a disclosure.
- 3.6 Aggregated or de-identified data. We may share non-personal or aggregated insights that do not identify individuals.
4. Data Retention
We retain personal information for as long as necessary to fulfill the purposes in this Policy or as required by law. Communications data (including recordings and transcripts) may be retained for up to five years to enforce rules, investigate incidents, or improve moderation systems, and may be retained longer if a dispute, investigation, or legal requirement is ongoing. When data is no longer needed, it is deleted or anonymized.
5. International Transfers
We may transfer data to the United States or other jurisdictions where we or our service providers operate. For users in the EEA or UK, transfers rely on Standard Contractual Clauses or equivalent safeguards.
6. Your Rights
Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict processing of your data, and to withdraw consent where applicable. You may request deletion of recordings or transcripts unless retention is necessary for legal, safety, or enforcement purposes. Rights requests may be submitted to support@thepromptists.com.
7. Cookies and Tracking
We use cookies and similar technologies for authentication, functionality, analytics, and security. You may disable cookies in your browser, though certain Platform features may not function properly if you do.
8. Security
We implement administrative, technical, and organizational safeguards appropriate to the sensitivity of the data, including encryption, access controls, logging, and secure storage of communications recordings. Stripe processes payment data under PCI-DSS standards.
9. Children's Data
The Platform is intended for Users aged 18 and older. We do not knowingly collect personal data from children. If we become aware of such data, we will delete it promptly.
10. Changes to this Privacy Policy
We may update this Privacy Policy at any time by posting the updated version on the Platform. Continued use of the Platform after the effective date constitutes acceptance of the updated Policy.
